Hourly Fee Cases

All Cases (other than Social Security, Veterans Administration, and Bankruptcy cases):

Elizabeth H. Scherer Attorney At Law, LLC charges on an hourly fee basis, with a retainer fee, billed monthly. At your initial consultation we can estimate the approximate total cost of your case. However, it is impossible to set an exact cost as many variables occur throughout the life of a case. Your retainer fee will be put into a trust account, out of which we will pay ourselves on a monthly basis. If it nears depletion, you will be required to replenish it.

Out-of-Pocket Fees/Expenses:

Elizabeth H. Scherer Attorney At Law, LLC requires payment for all out-of-pocket expenses it incurs or expects to incur (for example, the cost of court reporters, mediators, arbitrators, court filing fees, deposition fees, expert witness fees, and etc. ). You will be required to pay all out-of-pocket expenses in addition to hourly attorneys’ fees regardless of the outcome of your case.

Flat Fee Cases

Chapter 7 Bankruptcy Cases:

Elizabeth H. Scherer Attorney At Law, LLC charges on a flat fee basis for bankruptcy cases. All fees, including but not limited to attorneys’ fees, filing fees, credit check report fees, and credit counseling fees are due prior to bankruptcy filing. At your initial consultation we can estimate the approximate total cost of your case. However, the exact cost of a bankruptcy case depends on the complexity of each individual case (for example, the types and amounts of assets, debts, trusts, income and etc.).

Chapter 13 Bankruptcy Cases:

Elizabeth H. Scherer Attorney At Law, LLC charges a flat fee for Chapter 13 bankruptcy cases, of which a portion must be paid up front. The remainder of our fee will be paid over time through the three to five year court approved Chapter 13 repayment plan. All fees in Chapter 13 cases must be approved by the Judge assigned to your case. If a case becomes unusually complicated or requires Court attendance at numerous hearings, we may ask the Judge to approve additional fees. Additionally filing fees, credit check report fees, and credit counseling fees are due prior to bankruptcy filing. At your initial consultation we can estimate the approximate total cost of your case. However, the exact cost of a bankruptcy case depends on the complexity of each individual case (for example, the types and amounts of assets, debts, trusts, income and etc.).

Bankruptcy Out-of-Pocket Fees/Expenses:

Elizabeth H. Scherer Attorney At Law, LLC requires payment for all out-of-pocket expenses it incurs or expects to incur (for example, the cost of bankruptcy court filing fees, credit check report fees, credit counseling fees, and any other fees deemed necessary for bankruptcy filing). You will be required to pay all out-of-pocket expenses in addition to attorneys’ fees regardless of the outcome of your bankruptcy case.

Contingency Fee Cases

Social Security Disability Cases:

Elizabeth H. Scherer Attorney At Law, LLC will charge you a fee for services,by filing a fee agreement or a fee petition with the Social Security Administration for its approval. This fee is usually approved as long as:

  • You and your attorney signed the fee agreement;
  • Your claim was approved and resulted in past-due benefits; and
  • The fee agreed on is no more than 25 percent of past-due benefits awarded or $6,000, whichever is less.

The limit on the dollar amount is established pursuant to 42 U.S.C. § 406(a)(2)(A), which is currently $6,000, but may be increased from time to time by the Commissioner of Social Security.

Social Security Out-of-Pocket Fees/Expenses:

Elizabeth H. Scherer Attorney At Law, LLC requires payment for all out-of-pocket expenses it incurs or expects to incur (for example, the cost of medical reports, which includes but is not limited to, copies of doctor and hospital records, and/or birth and death certificates). You will be required to pay all out-of-pocket expenses regardless of the outcome of your social security case.

Veterans Administration Disability Benefits Cases:

Elizabeth H. Scherer Attorney At Law, LLC will charge you a fee for services, by filing a fee agreement with the Veterans Administration. The fees will be 20% of past due benefits awarded. If fees are limited by the agreement to 20% of past due benefits, then they are presumed to be reasonable and the VA will pay them without question.

Veterans Administration Out-of-Pocket Fees/Expenses:

Elizabeth H. Scherer Attorney At Law, LLC requires payment for all out-of-pocket expenses it incurs or expects to incur (for example, the cost of medical reports, which includes but is not limited to, copies of doctor and hospital records, and/or birth and death certificates). You will be required to pay all out-of-pocket expenses regardless of the outcome of your Veterans Administration case. Expenses are not considered attorneys fees, and the VA will not pay or withhold the expenses on behalf of the attorney.
